Welcome to Smartzocks.com, the Website of Smartzocks Sverige AB (hereon referred to as “Smartzocks Sverige AB,” “we”, or “us”). These terms and conditions (the “Conditions”) apply to orders placed by the customer (“you”) in your capacity as a consumer for purposes unrelated to your trade, business, or profession. By using the Websites and submitting an order, you accept these terms.

By using our Website, Content or Services, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not use our Website, Content or Services. We recommend that you print a copy of these Terms for future reference.
If you have any questions, complaints or other requests you can contact us, you guarantee that the data you share with us is accurate and true. You agree to provide a real email address, of which you are the actual owner

We retain the right to modify these terms at any time and without notice. The version of the Conditions that was accessible on the Website at the time of your order is the one that applies to your order.

TO THE CONSUMER

We offer complete customer pleasure since we are sure that our socks are of the highest quality and meet the requirements of every home in the world. We will refund your entire purchase price if you are ever unhappy with our Smartzocks. The consumer bears only the return freight expense.

PLACING AN ORDER

To place an order, you must be at least 18 years old and possess a valid credit or debit card issued by a bank that we accept.

Please note that all orders are subject to product availability and that the appearance of a product on the Website at a certain moment does not guarantee that the product will always be available.

You may only place orders through the Website. Please ensure that all the information you submit is accurate. We will use the submitted information to contact you regarding your order.

OUR CONTRACT

After placing an order, you will receive an order confirmation email. Please note that this email serves as an acknowledgement and does not represent order acceptance. A contract is created when we send you an email confirming that the products have been shipped. Our contract will contain only the items stated in the confirmation email issued at the time of shipment. If we have already received payment for unavailable products, we will reimburse the corresponding amount using the same payment method.

PRICING

The Website’s prices include value-added tax (VAT) and are final. Please note that delivery expenses are not included in the prices and are payable separately.

Although we attempt to assure the accuracy of all information, descriptions, and pricing listed on this Website, errors may occur. If we uncover an error in the pricing of any item you have ordered, we will notify you as quickly as feasible and give you the choice of reconfirming your order at the correct price or cancelling it. If we are unable to reach you, your order will be cancelled.

Smartzocks Sverige AB is not liable for any fluctuations in currency or conversion rates that your bank or credit card company may apply when billing in your country’s currency.

PAYMENT

We take Visa, MasterCard, and American Express, as well as several local payment alternatives. We perform a normal pre-authorization check on your payment card upon receiving your order to ensure adequate funds to fulfil the transaction. The products will not be shipped until the pre-authorization check has been completed. Upon order acceptance, your credit card will be charged. Adyen processes every payment.

DELIVERY

Orders are shipped within the EU from Sweden (Orebro). You may select regular shipping, monitored shipping, or express delivery when placing an order.

Please consult the table below for details on our delivery times. We try to deliver your requested products within the timeframes listed in the table below. However, occasionally delivery timeframes are extended owing to unforeseen circumstances, such as postal delays or acts of God. Dispatch times may also be lengthier during high-volume sales periods, such as the holidays.

Shipping expenses will be charged according to the selected delivery method when applicable. For shipping costs, please refer to our shipping cost table. If you have any problems regarding your delivery, please refer to our help page, where you will find contact information for the Smartzocks Sverige AB support team.

RETURNS

You may request a refund within 30 days after the delivery of your order for items that are returned to us in perfect condition. Returns will only be accepted if labels and original packing are unaltered and products are undamaged. Smartzocks Sverige AB cannot accept returns with removed labelling. You are responsible for returning things to Smartzocks Sverige AB at your expense. The loss of items during transport will not be compensated.

You are responsible for all return shipping costs; postal services may be used for returns. Consult your local post office for information on the official postal rates. Refunds for returned products will be issued using the original payment method within 14 days of receiving the returned product. Please note that the refund will cover the whole product price (including tax) but not the shipping charges.

Please note that merchandise cannot be returned to any retail location. We do not accept product exchanges.

COLOURS

We have attempted to reflect the colours of our products on the Website as accurately as possible. However, the colours you see may vary depending on your monitor, and we cannot guarantee that your monitor’s depiction of any colour will be accurate to one hundred per cent.

THE RIGHT TO CANCEL

If you reside inside the EU, you may terminate the contract within 14 days of obtaining the products from Smartzocks Sverige AB for any reason and without explanation. To exercise this right, you must give us a clear notice indicating your want to cancel the contract, either in writing to Smartzocks Sverige AB, Vesslevagen 5A, 70331 Orebro, Sweden, or through email to [email protected]. Alternatively, you may contact our Customer Service or submit the standard form supplied by your local Consumer Rights Authority. You must also return the products at your own expense without delay and no later than 14 days after the date of your cancellation notice.

Unless you have specifically agreed otherwise, we will reimburse the money you paid for the cancelled products using the same method used to make the payment, unless you have agreed otherwise. This covers shipping expenses for basic delivery, excluding any additional delivery fees incurred if you select a more expensive delivery method. We cannot pay for your return. The refund will be processed within 14 days of your notice to cancel the contract. However, we may delay the refund until we receive the returned product or until you show evidence of having sent the product back.

Please note that if you have handled the products beyond what is necessary to determine their nature, attributes, and functionality, you will be responsible for their lowered worth. Please note that the right of cancellation does not apply to products that cannot be returned due to health protection or hygienic reasons if such protection (such as plastic protection or labelling) has been removed after delivery.

COUPON CODES

Occasionally, discount or promotional codes may be issued; please note that the terms and conditions associated with such codes apply. A single promotional discount code may be used per order.

INDEMNIFICATION 

You agree to defend, indemnify and hold us and our officers, directors, employees, successors, licensees and agents harmless from and against any claims, damages, demands, obligations, losses, liability and expenses, including reasonable attorney’s fees, arising from: (i) your use of the Site or the Services; (ii) any breach of these Terms; and (iii) any violation by you of any third-party right, including without limitation any copyright, property, publicity or privacy right. This includes all actions taken under your account. This defense, hold harmless and indemnification obligation will survive any modification or termination of these Terms and your use of the Services.

All materials, including but not limited to images, illustrations, designs, icons, photographs, video clips, and written and other materials that appear on the Website (collectively, the “Content”) are copyrights, trademarks and/or other intellectual properties owned, controlled or licensed by Smartzocks Sverige AB. The Content and the Website are solely for the user’s personal, noncommercial use. You may download or copy Website Content solely for personal, noncommercial use. You acquire no right, title, or interest in any downloaded materials or software as a consequence of such downloading or duplication. You may not reproduce (unless as expressly permitted above), publish, transmit, distribute, display, alter, create derivative works from, sell or participate in the sale of, or exploit in any manner, in whole or in part, any of the Content, the Website, or any related software. The Website is protected by copyright, and Smartzocks Sverige AB owns all worldwide rights, titles, and interests in and to the Website.

LIMITATION OF LIABILITY

Smartzocks Sverige AB and its affiliated businesses are not responsible for any business-related damages or losses, nor for losses not caused by our breach.

Nothing in these Terms and Conditions will limit or exclude our liability for any issue for which it would be unlawful to limit or exclude liability under applicable law.

The Website and Content are provided “as is” without express or implied guarantees. Smartzocks Sverige AB disclaims any guarantees, express or implicit, to the maximum extent permissible by law, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

CHOICE OF LAW

These Terms shall be construed in accordance with the laws of Sweden without giving effect to any principles of conflicts of law. If you are a consumer in the EU, you are always protected by the necessary provisions of your country’s legislation. Any disagreement arising from these Terms shall be settled by the country of Sweden, which means that we may both file a claim with the Stockholm district court in Sweden. Nevertheless, as a consumer, you may also file a claim to defend your consumer protection rights in relation to these Terms in the EU nation where you reside.

DEFECTIVE ITEMS

These terms are unaffected by the statutory warranty regulations applicable in your country of residence. If you have a complaint involving a material or manufacturing flaw, please email us within a reasonable time after discovering the defect and include as much data as possible detailing your issue. The Smartzocks Sverige AB staff will then continue to assist you.

MISCELLANEOUS

Suppose any portion of these Conditions is determined to be invalid or unenforceable. Smartzocks maintains the right to assign or pledge any payment claims from your transaction to a third party.
